Disparate impact has been one of the most malignant and dangerous ideas arising from civil rights legislation and the courts. I notice it doesn't seem to be considered in professional sports, do they have an exception? I hope it's gone for good, but I'm sure that an executive order won't do that. I'm not a lawyer, but imo there needs to be a judicial reexamination of the constitutionality of existing civil rights legislation and the impact of the Griggs vs Duke Power decision.
